Terms of Service
General Terms

Effective for all commissions after August 1st 2020, I will need artistic freedom with the piece ( This is in terms of the art piece itself and NOT altering your character’s design. ) Please keep that in mind when commissioning me.

Intricately detailed descriptions and specificness about your piece ( I.e, no/little artistic freedom ) in terms of posing, camera angles and such will have extra charges

I’m not very fond of being pinged too often for updates, instead please stick to my Trello. You can however always contact me for changes.

I will not replicate other styles. I will not replicate the ‘style’ your character’s ref sheet is drawn in ( Chibi ref sheets, etc. ), nor will I copy other artist's styles. If you do not wish to get art in my style, please do not commission me.

I am allowed to decline a commission proposal if I so chose to.
Process of
Commissioning
This is the usual way of how my commissions go:

Discussion of details of the commission ( Includes providing the reference sheet of the character, total price, etc. )

Full payment / down payment to be made

You will be added to my Trello list, to which you will be given the link to if you want to keep track of progress of your commission or to see where you are on my commission queue.

Once it's your turn in my queue, I will work on a sketch WIP and show it to you, where you can approve it for continuation ( to finish ) or ask for changes until it's approved.

Finished product will be sent via email provided by the commissioner.
To commission me, please copypaste the following in our private chat or mode of communication and fill the form:
"I am aware and acknowledge your Terms and Services and agree to follow it. I also understand that it will be mostly artistic freedom as mentioned beforehand, and that turnaround time may vary a lot according to IRL situations."

Payment
MONEY PAYMENTS

I take payment upfront - before starting the commission, through PayPal using an invoice.

I recommend and prefer being paid the full price in one go.

If the price is too high to pay in one go, you may request to split it into 2 instalments. The first instalment must be made as a down payment of 40% the total price before starting the commission. With the first instalment, I will only finish the art until the final sketch wip. The second instalment must be completed after I present the final sketch wip. I will not finish the commission until full payment has been made.

If you want to pay in more than 2 instalments, an extra fee will be levied to make up for the conversion fee taken by Paypal ( Which is usually prevented by paying in one go. ) I only resort to the fee because the more instalments you make, the more money is taken from my end for conversion, which isn't fair to me to work for less the amount I quoted. ( Please keep in mind I do not live in a country where USD is used. PayPal takes a separate currency conversion fee for each transaction. )
Watermarks

I will not give unwatermarked versions of the commission. It is strictly not allowed to alter or remove my watermark. In doing so you will be immediately blacklisted and a public beware will be made, as well as you will lose all rights to the artpiece.

My watermarks are barely visible / dont cover up important parts of the commission. If you think your commission has an important part covered by it, ask me and I’ll move it.

I do not allow adding your own watermark to my art, that is strictly not allowed, and comes under editing my original work. Adding text when posting online to prevent theft is fine. ToyHouse image / logo watermarks are fine.
Copyrights

I own copyrights to all my artpieces I do for you. I have the right to use the piece for- My portfolio, presentation for college, presenting in exhibitions, advertising, selling as prints ( Only in the occasion that your commission is fan art of an official character from a TV series, anime, etc. )

I do not claim ownership over the character drawn ( Unless they are my own ), every credit for the character goes to the respected owner/commissioner

You do not gain entire ownership of the art given to you. I.e, you are NOT allowed to make edits to my work on your own without my explicit permission. You are not allowed to claim my work as your own. Filters put on them for your own aesthetic ( As FB avatars, etc. ) are allowed.
WIPS
Work In Progress
-
You will receive WIPS at the very beginning stage - the sketch stage - and whenever you ask for it. The first WIP will be given on my discretion, the rest you must ask for if you’re interested.

When you are presented with the sketch WIP, You have full freedom to ask for corrections or changes.

You are required to respond or give feedback to the WIP or else it will either be finished without your input, or all progress on your commission will be halted, hence the turnaround time will also be pushed back. So please do not ignore WIP messages.

If you fail to correct me on any mistakes when the final sketch WIP is presented and say it is okay, then return with corrections ( when I'm already in the lineart stage or past that ), there will be a possible editing fee and an undisclosed wait time.

Again, Do not message me for progress reports. That's what my Trello is for. Asking for progress will reports will only lead you to getting redirected to my Trello. You are however, fully allowed to message me for WIPS between time periods.

Please do not ask every 1-2 days for WIPS. I require consideration and patience.

If you are not happy with the wip and want a new sketch altogether, the old sketch will be sold off as a YCH.

I only allow 2 complete sketch do-overs. Minor edits can be asked and will not count as a do-over nor will be charged for. Any more than that, you will be refunded or asked for a fee.
Private
Commissions

If you want your commission to remain private ( i.e, not being posted anywhere online ), I require a fee of 20% of the price of the commission to be paid as extra and upfront along with the total price.

You must state beforehand that you want it to be private, not after it has been completed so the fee can be added to the price.

Failure to pay the fee gives me full permission to post it to the public.
Turnaround Time
&
Deadlines
The following turnarounds are only an estimate and not absolute:
-
SIMPLE artwork ( i.e, headshots, busts, single characters, less/no shading, half bodies, simple backgrounds, etc) : 1 - 3 weeks

COMPLEX artwork ( I.e, multiple characters, multiple details, detailed backgrounds, complicated poses, detailed shading, etc ): Depends on the details, likely 2- 4 months.
NOTE: The turnaround time is flexible and changes according to the current commission queue as well as personal projects. In regards to commissions that have a deadline, refer below.

I do not have a set turnaround time unless stated to you personally. All commissions have no deadline unless laid out beforehand.

If you need it before a specific date that is not before my normal turnaround time, no rush fee will be incurred.

Rush fee = 30% extra of the total price.
Refund
Policy
-
Asking for a refund on unfair grounds/ non-reasons ( Using reasons such as: "I do not want to wait that long", "I changed my mind", "I expected it to be done faster", "I need the funds for another commission / Something that's a non-emergency." ) will put you on the blacklist. Please only commission me if you have all the funds to do so.

Commissioning and asking for a refund immediately a few days or a week after commissioning will put you on the blacklist. You must understand that art is a luxury. Do not pay for it if you cannot afford it in your current living state.

I allow refunds within reason. You can get a 100% refund if I haven’t started on the commission ( I.e, only the amount I received AFTER all PayPal fees have been cut. )

You will only get a 75% refund if a WIP or sketch has already been finished and shown to you.

You will only get upto a 30% refund if I’m already in the major stages of the commission, i.e - linearting, flat colouring or shading/rendering.
-
If a refund has been requested after a WIP or sketch is already done, I have the right to resell the sketch as a YCH or use for other commissions.

I do not give refunds if the commission is in the finishing touches stage or already finished and delivered.
NSFW
Not Safe For Work

I am not open to certain extreme fetishes ( Such as- scat, waterboarding, watersports. ) . ASK ME before commissioning.

Certain fetishes may increase the price of the commission.

I will require ID proof that you are 18 years old or over in order to order a NSFW commission from me.

By commissioning any mature content ( NSFW ) you agree you are a legal adult ( Above the age of 18 ) and have no legal restrictions against buying mature sexual content. If you are found to have gone against this, you may solely be held accountable by law and will be blacklisted and publicly bewared.
NFTs
( Non-fungible token )

I do not consent to having my art or any creative service done by me to be used as a NFT, for NFT trading, or anything related to NFTs.

I will not do NFTs, ever.

Failure to follow this will result in serious legal actions.
Miscellaneous
ICONS:

Please understand that trying to optimize icons according to 100x100 and 50x50 will compromise the quality of the icon gif. If you are unsatisfied with my resizes, you may do it yourself as the original icon is given to you as well.

You are not allowed to edit them whatsoever, other than resizing.
ADOPTS:
-
If I have made adopts on a base, you MUST follow the base maker’s rules as well as mine.

You are allowed to:

Use my designs for profit and commercial use with credit to me.
-
Change their gender, design, traits, etc.
-
You will own all character rights to the adopt.

You are not allowed to:
-
Edit the adoptable artwork given to you at the time of buying. This includes removing signatures, details, watermarks, backgrounds, cropping the artwork etc.

Claim the design as your own work.
-
Recolour the adoptable artwork. If you so chose to change anything on the design, please make a new reference sheet for it. You will not alter my artwork.

Please do not draw the character you adopt from me in any racial discriminatory or prejudicial art. This is a humble request as I do not want my designs to be tied to that.

I do not do refunds on adopts after they’d been bought. It is your responsibility to sell them after they’d been bought.

Do not hike up the price of the adopt if you want to resell unless they come with extra art.

Failure to comply to these instructions will blacklist you from buying anything from me in the future.
